1. Agreement to Terms 条款同意

By accessing or using Zaokit ("the Service"), available at zaokit.app, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not access or use the Service.

2. Description of Service 服务描述

Zaokit is an AI-powered content visualization platform that generates cover images, social media image sets (e.g., Xiaohongshu / XHS format), and article illustrations from text input. The Service uses artificial intelligence models to process your content and produce visual outputs.

3. User Accounts 用户账户

  • You must create an account to use certain features of the Service.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate and complete information when creating your account.
  • You are solely responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.

您必须创建账户才能使用本服务的某些功能。您有责任维护账户凭据的安全，提供准确完整的信息，并对账户下发生的所有活动负责。

4. Subscription & Payment 订阅与付款

  • Free Tier: We offer a limited free tier with a set number of content packs per month.
  • Paid Plans: Paid subscription plans (Plus, Pro, Ultra) provide additional credits, features, and higher quality outputs.
  • Billing: Subscriptions are billed monthly through our payment provider, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
  • Credits: Unused credits do not roll over to the next billing period.
  • Cancellation: You may cancel your subscription at any time. Access to paid features will continue until the end of the current billing period.
  • Refunds: Refunds are handled on a case-by-case basis. Contact us at [email protected] for refund requests.

5. Content & Intellectual Property 内容与知识产权

  • Your Content: You retain ownership of any text, articles, or other content you submit to the Service.
  • Generated Content: Images and visual content generated by the Service using your input are licensed to you for personal and commercial use, subject to your subscription plan.
  • License Grant: By submitting content, you grant us a limited, non-exclusive license to process your content for the purpose of providing the Service.
  • Restrictions: You may not use the Service to generate content that infringes upon any third-party intellectual property rights.

您保留提交内容的所有权。由本服务生成的图像和视觉内容根据您的订阅计划授权您用于个人和商业用途。您不得使用本服务生成侵犯第三方知识产权的内容。

6. Acceptable Use 可接受的使用

You agree not to use the Service to:

  • Generate illegal, harmful, threatening, abusive, or hateful content
  • Generate content that exploits or harms minors
  • Impersonate any person or entity
  • Distribute malware or engage in phishing
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to the Service
  • Use automated tools to excessively access the Service beyond normal usage
  • Resell or redistribute the Service without authorization

您同意不使用本服务生成非法、有害、威胁性或仇恨内容，不冒充他人，不干扰服务基础设施，不试图未经授权访问服务，不过度使用自动化工具，不未经授权转售或再分发本服务。

7. AI-Generated Content Disclaimer AI 生成内容免责声明

The Service uses artificial intelligence to generate visual content. AI-generated outputs may not always be accurate, appropriate, or aligned with your expectations. We do not guarantee specific results or quality levels. You are responsible for reviewing and verifying all generated content before use.

本服务使用人工智能生成视觉内容。AI 生成的输出可能并不总是准确、适当或符合您的期望。我们不保证特定的结果或质量水平。您有责任在使用前审核和验证所有生成的内容。

8. Service Availability 服务可用性

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

我们努力保持服务的高可用性，但不保证不间断访问。服务可能因维护、更新或不可控因素暂时不可用。我们保留随时修改、暂停或终止服务任何部分的权利。

9. Limitation of Liability 责任限制

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZAOKIT AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

在法律允许的最大范围内，Zaokit 及其关联方不对任何间接、偶然、特殊、后果性或惩罚性损害或利润损失承担责任。我们的总责任不超过您在索赔前 12 个月内支付给我们的金额。

10. Termination 终止

We may terminate or suspend your account and access to the Service immediately, without prior notice, if you breach these Terms of Service. Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time by contacting us.

11. Governing Law 适用法律

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through good-faith negotiation or, if necessary, through binding arbitration.
